Hello everyone...
I have been listening to Marc's radio show for a while and find his stuff spot on. As you can tell from the thread subject I am in the unfortunate position of having to live in Fascist New Jersey. If you have never had the pleasure of visiting the Garden state then count yourself as one of the lucky ones....

I have a quick question about another noise summons my son received at the hands of a truly evil female officer. Now I know the gender doesn't matter because evil comes in all flavors but this female revenue collector is notorious for her actions in Forked River NJ. She works the night shift and I guess that pisses her off but she always makes a point to come by the house to make sure that my teenage son is not having any fun.

One evening my son had a few friends over (the wife and I were there and approved of the small gathering). Like clock work the officer showed up and issued my son a noise complaint. He was outside saying goodbye to his friends and there was no noise as was attested to by another officer that was on the scene. The other officer told my son to go inside and have a good night but the dragon lady argued with the other officer to issue a summons. The male officer refused because he said there was no reason because there was no noise. Obviously this didn't sit well with the female officer and she issued the ticket anyway. As a side note my son is a deans list student in college and is very respectful and basically an all around good kid. He delivers pizza in our town when on school break and is friendly with most of the revenue collectors in our town.

I eluded to the fact that this happened before (ticket issued by the same dragon lady for the same offense) and we went in to plead not guilty. After speaking with the prosecutor we got the fine reduced to $50 and $35 court fees, down from a potential $800 ticket, (We minimized the damage). I really hate the smug attitude of this officer and would really like to see her challenged and knock her down a peg or at least be able to give her a sarcastic wave as we walk out with a minimal fine.

Does anyone have any suggestions as to how they would handle this if it were them facing the same situation? We have a court date of 4/3/12.

Sorry about the length of my first post.....but I finally am able to communicate with people that actually get the truth and not the mind controlled babble that we are fed everyday....

I don't know how familiar you are with Marc's work, but it would probably be best to address the officer on causation. In other words there is no injury or damage; nobodys legal rights have been violated, there is no victim.


I suggest you email or maybe even PM Marc here on the forum, and he can kind walk you through the steps and explain the process. He has it chisled down to about two questions asked to the officer that will have him/her "impeached", or disqualified as a witness.

Don't worry about the length of your post. Wink
Kel is spot on. There is no case as there is no cause of action (consisting of three elements: Injury, Damage, Redress-ability.)
If you feel strongly about this you should fight it in court. If not, take the reduction in fine and go home. I hope you fight it, but that is a choice that only you can decide based upon your own situation and desires.

I think you might want to invest in an hour of consultation with Marc, or at the very least, call in (EARLY) to Marc's radio show this Saturday (218-632-9399) and have him walk you through the steps. You would be well served by reading Marc's book, but there is not time for that before your hearing.

Also, note this well, you should practice, practice, practice before your court appearance so that you feel confident with your position and do not get flustered right off the bat by the intimidation factor of the entire legal system.
