Hey all...I have a quick concern about an upcoming traffic violation in Maryland

Hey everyone

Id like to first start off saying, that im aware of the information Marc Stevens has brought to us, and i believe that the information is VERY VERY USEFUL. My only problem is ive recently received a speeding ticket. So please excuse any TYPO's that i may make because ill be typing extremely fast, lol

To explain what happened, it  all started while i was driving through a MALL parking lot, I do have a slightly modified car with an Aftermarket Intake and an Aftermarket Y-Pipe in which, whenever i depress the gas pedal. My car gives off  growl, and may sound like im flooring the accelerator pedal. Now with this being said, i was driving through the mall parking lot with my girlfriend in the passenger seat, going to pick up her little brother from his job in the mall. Apparently there had been an incident at the mall, and there were already 4 other police cars blocking off a portion of the mall driving area...So i detoured around them only to come out at my destination. There were 2 other police officers in that immediate area. So my girlfriend and I see her little brother and honks the horn at him to get his attention. He see's us and runs over to the car, he gets in, and One of the police officers in the immediate area asks him before he gets into the car, IF "I WAS HIS RIDE", and my girlfriends little brother answers "YES"....that police officer simply states "OK, have a good evening, and NODS". Just as im about to pull off, i see this cop RUNNING OUT OF NOWHERE running toward my car saying to the officer that just said, "have a nice evening".....HE IS SAYING DONT LET HIM LEAVE, DONT LET HIM LEAVE....So i stop...Naturally.

Now this cop that was running gets to my vehicle and SIMPLY starts to curse my out by saying...."what the F--k is your problem?", "why theF--k were you speeding in a parking lot?" and "YOUR OUT OF YOUR D*mn mind" ETC...

I REPLY IN a calm manner...."officer i wasn't speeding, but i do have a slightly modified car, that growls a bit any time you tap the accelerator pedal", and then i proceeded to tell him that i have an Aftermarket intake and y-pipe that makes my car growl". I even stated to the officer, you can look up under the hood of my car If you would like..

He then replies in a yelling tone "I DON'T WANT TO LOOK UNDER YOUR GOD DAMN HOOD"....."you dont know sh*t about cars"

after he replies stating I don't know sh*t about cars...i state, "oh officer i work on cars a little bit as a past time, or a hobby SORT TO SPEAK"

he is very flared up at this point, and is simply having complete disregard that there is a woman sitting in my passenger seat. The officer then states "where do you work on cars at since you f--king know so much about them.

Once again in a calm manner, i state....officer i only work on cars as a past time or hobby, and even then i really only do car audio...but my profession is Information Technology"....he then replies with...."WHO GIVES A  F--k"......Then he asks for my "ID" not my drivers license and registration.....BUT MY "ID"......

So i hand the officer my Drivers license, as requested, he didn't ask for my registration. He then walks toward the other police officer...the one that said to us earlier "HAVE A NICE EVENING"...

now at this point my girlfriend, is scared or afraid because of that outburst that he displayed...While the officer is talking to the other guy  it looks as if they are just standing there.. I also noticed that he did not have a squad car, nor did he have a ticket book...

So about 25 minutes later.......A mall vehicle pulls up, and another cop gets out of that truck, ...ill call him Officer Tilghman....

In about 5 minutes Officer Tilghman comes back writing me a ticket for speeding in the parking lot, when OFFICER Tilghman was not the officer who accused me of speeding,  i then proceed to put my Treo cell phone on voice record so i can record any more potential outbursts by the first cop. HE HAS THE audacity to take my Treo cell phone out of my hand and put it on my hood, as if he knew what i was doing.

Officer Tilghman hands me the ticket and i sign it, and i ask officer Tilghman why he is writing me the ticket when he wasn't the one who is accusing me of the action, and i then asked him, who would be appearing if i were to take it to court...Officer Tilghman said "WE BOTH WILL"...I said OK OFFICER, Thank you. I also asked what the other officer's name was and They both stated to me "I DONT NEED TO KNOW THAT INFORMATION.

I never once lost my cool, and i did not come off arrogant...and i know FOR A FACT THAT I DIDN'T because i had my girlfriend in the passanger seat, and her little brother in the back of my car...So i was trying to remain as calm as possible and avoid any more potential frustration.

Now I myself, am a 21 year old college student who resides in Baltimore, MD. I work full time for the State Of Maryland as a computer technician in one of the Information Technology Departments. I live with my parents, and ive never had problems as far as the law is concerned...other then maybe a parking ticket. I drive a 2001 Nissan Maxima, and my insurance is already high because I LIVE IN THE "CITY" of Baltimore.

Im looking for some insight or some relating information on how i can relate this incident directly with Any Maryland Driving law, or authority that the police might have

Based on the video's from Marc Stevens....There would have to be a violation of legal rights, resulting in Personal injury to either myself OR HE; The POLICE OFFICER...WHERE he could have Lawfully written me a ticket OF ANY KIND. Now with that being said...

is there a law i could find or reference to him not having the right to give me a ticket?

Is there any Maryland Law or US Supreme court law i could reference?

Is there a source as far as the Maryland constitution goes....that i could look up?

Could any one provide me or link for this information?

The ticket that the other officer wrote me read "SPEED GREATER THAN REASONABLE"....There were no posted signs anywhere stating the speed limit, and i know for a fact that i hadn't gone above 15 Miles per hour......and i also know FOR A FACT THAT WHERE I MADE MY DETOUR AT, there were NO OTHER CARS IN THE AREA, it was like a VACANT part of that parking lot, and THERE WAS NO ONE AROUND ME FOR at least 600 FEET. I also know that there was no radar gun or laser gun used in the situation.

I will also be going to that court house and asking for a "REQUEST FOR MOTION" in regards to that ticket.

Please post with replies as i NEED SOME ASSISTANCE, if any more info is requested please DON'T HESITATE TO ASK.

I know nothing.  Good, now that that's out of the way...

The only thing I can think of off the top of my head is the mall security guard was a witness and from what you said it seems he did not have a problem with your driving. 

But I would guess that, just like everything else, it is not a matter of finding the "magic bullet" law, but rather to take it to court and use Marc's ideas to get it thrown out for lack of standing and such.

ok...i understand you immediate premise. But i may have made a mistake....the SECOND cop that pulled up in a Mall security vehicle was INDEED A COP....He must just didnt have his cruiser with him. But ill just continue to look into Marc's Idea and how i can further make it apply to my situation

How about getting a copy of the CCTV feed of the parking lot from that time?

Not at all marc, I violated no one's legal rights...which essentially means that the officer had NO jurisdiction correct?

This tells me to be better prepared for WELL LAYED TRAPS
