Police crap in Alabama
Hi I am Soni from Alabama and this is what happened to me. I will just post the affidavit and add what has happened afterward. I realize that things could have been handled differently both ways and somethings may or may not have been the most applicable in the situation but I made the stand. I am learning a lot from this and any constructive criticism welcome.
I was traveling down 231 to Huntsville at about 1am Friday morning on the twenty third day of September, while in Arab I noticed a police car parked in a lot, as I went up the road just a little the officer pulled out and run up behind me. I signaled over and he hit the emergency lights. Officer Vaughn approached the window and I held my hands in plain view, He immediately asked for a drivers license at about the same time I started reading to him ( USC title 5 sec. 552a (e) (3) which authorizes a "Citizen" to use a form to collect information from he Public Servant to determine whether to divulge information to the Public Servant and employing agency. Public Law 93-579 states " The purpose of this Act is to provide certain safeguards for an individual against invasion of personal privacy requiring federal agencies... to permit an individual to determine what records pertaining to him are collected, maintained, used or disseminated by such agencies..." I then briefly explained if he didn't choose to answer I had a Legal Brief and Constructive Notice, I also stated if he chose to ignore it all and depending on the action taken against me I could file a restraining order. Officer Vaughn got agitated and stated I couldn't do that, I responded I have a right to do this under the USC title 5 section 552a and stated it was the law, officer Lambert spoke up and said I was pulled over for impeding the flow of traffic and officer Vaughn spit out obstruction of view of tag. Vaughn brought up The Safe Streets act, I told him it was repealed in 99, but it was 98. Vaugh rebutted and laughed. It was then clear their intention from the parking lot was to pull a single automobile over on a deserted 231 at 1 am which I hadn't seen an automobile in 15 plus miles. Officer Vaughn asked for a drivers license, I told him I did not have one but I had a Common Law Identification card, he asked to see it, so when I was feeling around for my wallet officer Lambert screamed don't reach under the seat with I believe his gun pulled , I thought they was going to kill me I was in incredible fear for my life at that moment. They then ordered me out of the truck with the threat of their guns and yelling as they could plainly see I was no threat or yelling back. I reached to cut the auxillary switch on and roll the window up so I could lock the door, the yelling and threats started again, they snatched the door open and as I was trying to click the seat belt officer Vaughn was still ordering me out while snatching the seat belt just as I pushed the release button.. While I was getting out I told them they had no consent to search and they need to get a warrant. ( THEY SEARCHED ANYWAY). Officer Vaughn found my wallet, handed it to me and I give him my Common Law Identification card with my name Soni-Dale:Carlee on it, Vaughn called it in and didn't get anything and stated it was fake, I responded it's not fake it is lawful and the same recorded information at the County Court House and that is how my friends and relatives know me. Officer Lambert asked me if I had or used another name and I told him yes" Jackson" but only when he asked, I don't use Jackson anymore because my real family name is Carlee. Officer Warren was on the scene by this time and the wrecker had been called. I told officer Lambert I had personal items in the vehicle and was intending to ask about the honesty of the wrecker company but he went straight to inventory(SEARCH) they did write or act to write a few serial numbers down but searched my personal items and asking me what some things were while Officer Warren held me at the back of my automobile under threat of arms. I heard Lambert tell Vaughn " Do what you need to do". Vaughn arrested me and I made no attempt to resist. I didn't find out what for until at the station. (fake ID), I still contested it was legal and it is. (no particular order but at some point I had told the officers I had a right to travel and Lambert assertively commanded it's a privilege and I don't have right to travel he had also stated supreme court laws were for congress and not me or something to that effect. Lambert also brought up something about a sovereign killing a cop or sovereigns are cop killers insinuating I was a cop killer or all proclaimed sovereigns are dangerous, that is the way I felt he was coming across, I responded that cops also kill a lot of innocent people, making the point his classification was flawed. There were some questions asked back and forth on the scene but I don't remember much of that. Truck was impounded, 175.00 to get it. Bail $50 A-aa bonding. Radio, evening new and the web. News Alert:......105.5 at 10:11pm Reported that a Jefferson County man was arrested in Arab, it stated 30 yro Soni Dale Jackson was arrested for showing a fake "drivers license" and was part of an anti-gov't group. Said He was a Sovereign citizen. (I never said the word Sovereign or claimed to be although there is nothing wrong with it) we are all sovereign as far as I understand. Jackson was on the birth cert. but was never a true family name and I had never thought about it until I was learning about the family geneolgy, that's when I chose to use a name from the true linage. I feel I am right on this issue. These are court cases I found while looking into a name change that I based my decision on. Common Law Name Change: A person may be employed, do business, enter into contracts, sue and be sued under any name they choose at will (Lindon v. First National Bank 10 F. 894, Coppage v. Kansas 236 U.S. 1, In re McUlta 189 F. 250). Such a change carries exactly the same legal weight as a court-decreed name change as long as it is not done with fraudulent intent (In re McUlta 189 F. 250, Christianson v. King County 196 F. 791, United States v. McKay 2 F.2d 257). After the fact: The magistrate set a hearing but it was really an arraignment, I chose to not plead in a court of no record and entered a demur, the Judge said the demur was abolished in 67 and entered a plea for me and I objected to his decision, He then set a hearing and when I left the court emptied, twenty or so people came for my support. I wish I had knew more to make a better argument then. There was no media or troops there that day, it was normal. The hearing: Low and behold, I arrived to two or three buses parked in front of the court house with SWAT, the media and the police. I entered the court to a slap shift metal detector and media cameras. I admit that got me real nervous and everything I've learned I questioned, but no matter what I had or had not done right up to that point I knew I was no real criminal and all my family and friends that knew me and my real character and not what the media had painted would never be questioned. That was my strength. I knew they were out for me so I stipulated to an appeal to get it out of that court, the prosecutor asked for maximum fines and sentencing upward to a year and 1600 dollars. Oh I had asked where was the evidence of the complaining party at one point but was ignored, this was around the time I appealed. The Judge said I had 14 days to appeal, I left. The news reporter asked me for a comment and I gave him one, He printed it verbatim to my surprise. Appeal day: I called in to the court that morning to ask a question or two and told them I was coming to take care of the appeal. I arrived to the normal everyday procedure, no extra troops or the media. The bondsman warned me and I left with evidence to kill one of my charges but after reading Marc's book and learning about standing, causes of action etc. maybe I'll be more prepared to do a better job. I'll jump into things feet first even when I'm scared, I've just never figured out if it is a weakness or strength, but I am ready to fight. Sometimes I ask myself if it's worth it and the answer is always yes! |

Heh man sorry to hear about all your troubles. Just remember that you are the rational and peaceful guy in all this, don't let them bait you into acting otherwise. They called up the fucking SWAT team because you had the audacity to present a piece of paper to a man in a uniform that was not approved by some so-called "legislators". If that isn't paranoia, I don't know what is.

Maybe the paper was loaded and thanks for the support. My goal is to bring their crap into the light, even if it is only for a moment.
