Question Newbee juror
After filing four motions for two traffic cases now I get a "Juror Qualification Questionnaire". (Not a Summons) I have been dismissed from jury duty at least once before. The last time I received a juror notice I blew it off and never heard anything more about it. This notice says that "If you do not complete this questionnaire, you may be summoned to report at your own expense for completion of your questionnaire at this office".
They give me one week to submit, 7/26/12

The part that bothers me is that they have the name (potential juror) at the top of this document in all caps (corporation) and they want this signed and dated.
Since I claiming to be a Natural Person in two traffic cases I'm not to keen on signing this document.
Any questions that could exempt me require explanation in the remarks section on the reverse.

Should I...
A. Complete and NOT SIGN
B. Complete and NOT SIGN with explanation (natural person, administrator for account) in remarks.
C. Add in remarks that I know my rights as a juror and that I know I do not have to find someone guilty of a law that I do not believe is just.
D. Any combination or other suggestions?

Not interested in jury duty, they definitely don't want me on a tax case!!!!

I'll reply to this since it's right in my "wheelhouse."

Send them the following letter (registered) and watch the fun start:

Dear Sir or Madame:

I received your official jury summons in the mail. It included a form that I was instructed to fill in and bring with me when I reported for jury duty. I have questions about this form.

There is a space on the form for me to sign and date it. However, I have the following questions before I do so:

- Is my voluntary signature a necessary element to a properly completed jury questionnaire?

- Is my signature considered voluntary if offered under coercion and threat of incarceration?

In addition, one of the questions on the form asked if I was a citizen of the United States. I did some research and found the following:

- Citizenship is membership in a political society, and implies a duty of allegiance on the part of the member and a duty of protection on the part of the society. These are reciprocal obligations, one being a compensation for the other.
Luria v. United States, 231 U.S. 9 (1913)

- The Constitution is a charter of negative liberties; it tells the state to let the people alone; it does not require the federal government or the state to provide services, even so elementary a service as maintaining law and order.
Bowers v. Devito, 686 F.2d 616 (7th Cir. 1982)

So, if the Constitution does indeed not require the state to provide law and order, then it doesn't require them to do anything. And logically, if there is no obligation to protect, then there is no reciprocal obligation of allegiance. Therefore, since there is no obligation of allegiance, I don't believe I am a citizen, but I didn't want to mark "No" for the answer until I could clear up my confusion.

Please respond to my concerns regarding your summons and we can proceed from there. Thank you in advance.

Sincerely,

Okay, so I went. Here's my story:

My pool (sounds so refreshing) got called right away. It was civil (corporate negligence), not criminal, so jury nullification doesn't apply if I understand correctly. 9(!!!) of the 12 selected in the morning were dismissed by the afternoon (they gave some pretty birdbrained answers to the questions asked, but they got dismissed so maybe they were crazy like a fox), so of course I got picked in the next wave since the pool was greatly reduced. When the judge (a hot tomato-- yowza) asked me the requisite personal questions, I made her laugh. In response to if I had any children, I counted on my fingers 1, 2, 3, 4, then said "nope, no children." I was called back to her chambers with all the "lawlers" (very initimidating) and took the opportunity to give her a copy of my letter with my questions (the one the Jury Administration chose to completely ignore, the worms). She grilled me on the whole citizen thing, but it's all a blur. I remember saying something about how in a free market, jurors could serve voluntarily and be paid fairly, unlike now. When I returned to my seat in the court room, I could hear murmuring like "harumph, harumph, harumph..." then the next thing I knew the judge came in and said I was dismissed and to see the bailiff outside. I was a tad worried, but he just gave me my meager restitution (17 whole bucks) and I high-tailed it out of there. I was not about to stick around.

That was it. That was my close shave with Legal Land. I got a definite "ZOMG!!11!! We got one that can see!!!!" vibe. I did not enjoy being around so many pro-State trolls and never want to again (although at least the judge was not bad to look at). Big thanks to all who contributed to this thread over the years-- without the great information from you all, I wouldn't have managed. And of course, mega kudos to Marc, who is unquestionably doing "God's work." Heh heh heh.

And a question: How do I prevent this from ever happening again? I heard that you only get called for jury duty if you're a registered voter. I sent a letter to the board of elections a while ago asking them to remove my name, but they obviously didn't do it (what a surprise). Is there a way to be more insistent with them? Thanks again, everybody!

Now it's dark.

RE: Newbee juror
I have never been registered to vote, where they get their intel is beyond me?
The doc I received is a "Juror Qualification Questionnaire" not a summons for jury duty.
I just wonder if this has anything to do with filing motions?
The letter seems like a good plan to not sign the doc.
Still on the fence about what to do here since I still have two cases pending?Huh?
Thanks for both responses!
Next week I get to see two JudgesAngel

"Driver's License" records is a Stated source for many, if not most, "States". But any paperwork where one has Signed "Yes." to the question "Are you a U.S. Citizen?" etc They'll take.

NonE:

Wow, thanks for digging that up. You're a gentleman and a scholar. But don't worry-- I won't say a word about it to anyone. Tounge

gearheadmm:

You should probably put that letter in your "back pocket." You'll likely need it. They're obviously setting you up to do "hard time" as one of their indentured servants a.k.a. juror.

RE: Newbee juror
Please define "Back Pocket" lol

I know that there are also numerous precedences by the Supreme Court that state the Government doesn't have to protect you.

I guess I'll Print up a letter similar to yours and send it with the "questionnaire", let it ride, and see where it lands.

What...Me a CITIZEN??? Judgy wudgy
