Greetings from the Land of Oz - aka Kansas
Hello my fellow freedom seekers!

I am a new member to this site and forum. I have seen a few videos of Marc Stevens on Youtube, as well as listened to a few mp3's of him. All of which contained some VERY interesting views on "law". I like his style of delivery; it is intelligently humorous and witty!

I just ordered the Colorado seminar and book package for $30, as well as the template for Motion to Strike/Dismiss for $25. I suspect it will be [fake] money well invested.

I am in the midst of battling a traffic citation in my local municipal court for the following:

(these are what the ticket says)

NUMBER VIOLATION
1. STO 59b stop sign
2. STO 54a turn signal
3. STO 200a ins ?vvo? - this is illegible on the ticket

[I think I could say that these are extremely vague descriptions of the violation I am being alleged of committing]

I signed the ticket "ALL RIGHTS RESERVED UCC 1-308/UNDER DURESS AND PROTEST" with my signature next to those words.

(these are what I assume he meant, but not an admission of guilt by me)
running a stop sign (I did stop)
not using blinkers (I used my hand)
no insurance (I had insurance and have proof)

My knowledge of "law" started before this ticket was issued...BUT I did not know enough about "pleadings, motions, etc" to do much good to get the ticket dismissed BEFORE the arraignment.

I did file ONE COPY of a handwritten petition for judicial notice of special appearance at the arraignment on January 26th, 2011. I did not serve a copy to the city attorney's office yet.

I have since bought the "Jurisdictionary step-by-step self help course" by Dr. Graves so that I could learn how to draft proper papers to file in my record.

I think I MIGHT want to remove my handwritten petition from the record and replace it with a more proper motion...I am not really sure what would be better in my case; leave it in OR take it out and replace it.

The original handwritten petition DOES NOT have any memoranda or points of authority, but gives general knowledge that ANYONE in the legal profession SHOULD know as a matter of prudence, but seems that most do not.

I DID NOT enter a plea of any kind. The judge entered a plea of not guilty. Then, he coerced me into signing a WAIVER OF COUNSEL by threading me with contempt of court.

I signed it including "ALL RIGHTS RESERVED WITHOUT PREJUDICE UCC1-308", scratched out DEFENDANT where the signature goes, and indicated at the top of the document in the caption "SUI JURIS, DEFENDANT IN ERROR".

I am hoping to learn some valid and lawful techniques for overcoming this battle over a traffic ticket.

Thanks for being great at what you do Marc - and EVERYONE else out there trying to make this land we live in a better place to exist!!!! :frobro:

Re: Greetings from the Land of Oz - aka Kansas
I am not getting into the UCC except for the "reservation of rights". UCC 1-308 is easy to understand - BUT the rest is weird.

I believe that even if it does go to trial - and NOTHING helps to dismiss the charges - that I have EVIDENCE that I did have insurance on the day I was pulled over by the cops.

I have a copy of my insurance from my insurance guy WITH dates...which in essence, states that I had insurance coverage on the day I got pulled over.

I KNOW at least that charge will be dropped...

The other two, I am hoping, will be dropped as well.

Besides, my girlfriend was with me in the car and says that I stopped AND used my hand as a turn signal. (SHE is my witness!)

She can't understand why I was even pulled over in the first place.

As I am thinking about this; does Marc offer any information on filing a motion for Discovery? I REALLY would like to see the dashboard cam from the police cruiser - - - - - - I don't have a clue WHERE this cop was sitting before he came after me to pull me over.

I would like to see the cops perspective of me "committing" the "crime" he cited me for. Maybe his view WAS obstructed, and could not see me CLEARLY use my arm as a turn signal. I would like to find out.
