Successfully Put a Hold on a Warrant
On December 7, 2010 Julio received a Warrant Notification on a ticket he thought had been resolved. On December 15, 2010 Julio,myself, and Marciano when to the La Feria Precinct to file a Motion to Quash the Warrant. We showed up at about 1:30pm and he was told that he had to speak to the âjudgeâ who would be back a 3pm. The court clerk told him he could not leave and if he attempted to leave the constable would arrest him. The judge returned at about 3 and get this, the judge refused to speak to Julio. They kept him there til about 4 and finally agree to set the matter for a pretrial hearing on January 20, 2011 at 10am with the county attorney. From the many conversations we had with the court clerk it was our conclusion that the court was somewhat confused by the motion we had filed. Julio's 3 charges dismissed. Two were no big deal. Here is a little history on the situation. Julio had received a ticket back in 2005 for speeding, no insurance and no driver's license. In 2009 he paid the speeding and was told that the other 2 charges were drop because they had verified them. On December 2010 he received a warrant notification letter. On 12-15-10 we filed a Motion to Quash Warrant with success, an the court set a pretrial hearing for the 3 charges on 1-20-11 (the no insurance, no driver's license, and they added a failure to appear). On January 7, Julio filed the Motion to Dismiss and the Discovery Request. He was quickly contacted by the county attorney and told that the no insurance and no driver's license charges were being drop and that he had to talk to the judge about the failure to appear. A day or two later he was told that the failure to appear was also drop. I need to learn how to draft motions in Nevada. Armando, could you direct me to where I can get decent training to do so? Books, videos, websites? I am not going to school, I refuse to sell my soul to have a bunch of Marxists try and teach me how to think like they do. Plus, I have very little "money" at the moment. I plead guilty 2 years ago to a few speeding tickets(5-15 mph over each) before I found out what was really happening. Now I never paid them, of course. Now I have warrants. So I have to file a motion to quash, and attack the original complaint. Its my only option to keep from going to jail.

But that's just me trying to draft and I don't really have any personal experience nor do I play a stock car racer on TV. - NonE "I just don't understand how this happens."

I have been outside racing the gokarts today. Haha Synchronicity at work! :wacky: Yeah, I was thinking of paying for a few classes, but I do not want to go to school for it, I would rather just have someone teach me how to draft motions.
